1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your use of the 970techsolutions.com website and any services provided by 970 Tech Solutions ("970 Tech Solutions," "we," "us," or "our"), including device repair, business IT support, web development, and tech consulting services. By requesting a quote, submitting a device for repair, engaging us for IT or web development work, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Description of Services
970 Tech Solutions provides four primary service lines: (a) consumer device repair, including phones, tablets, laptops, desktops, and game consoles, offered locally in Northern Colorado and Southern Wyoming and nationwide via mail-in service; (b) small business IT support, including network setup and management, workstation setup, remote IT support, cybersecurity services, cloud setup, and backup solutions; (c) web development, including business websites, e-commerce, landing pages, and ongoing maintenance; and (d) tech consulting, including technology audits, software and hardware recommendations, and staff training. Specific scope, pricing, and deliverables for any engagement will be confirmed in writing (email, invoice, or signed agreement) prior to work beginning wherever practical.
3. Service Agreements & Scope of Work
For business IT support, web development, and consulting engagements, the specific scope of work, deliverables, and timeline will generally be outlined in a proposal, invoice, or statement of work. Any work requested outside of that agreed scope may be treated as a separate, additional engagement and billed accordingly. We will make reasonable efforts to flag scope changes before performing out-of-scope work.
4. Estimates & Quotes
Any estimate or quote provided verbally, by email, or through our website is an approximation based on the information available at the time and is not final until confirmed in writing. Actual costs may vary once a device has been fully diagnosed or a project's true scope is understood. We will not proceed with billable work beyond a diagnostic fee (where applicable) without your approval of a finalized quote.
5. Payment Terms
Payment terms vary by service line and will be communicated at the time of engagement. In general: device repair balances are due upon completion, before the device is returned or picked up; mail-in repairs may require a deposit and/or diagnostic fee collected up front (see our Mail-In Repair Terms for full details); business IT and web development engagements may require a deposit prior to starting work, with the remaining balance invoiced upon milestones or completion; ongoing IT or maintenance plans are billed monthly in advance. We accept standard electronic payment methods as made available through our invoicing system. Invoices not paid within 15 days of the due date may be considered past due and may accrue a late fee of 1.5% per month or the maximum allowed by Colorado law, whichever is less, and may result in suspension of services or return of the device.
6. Warranty on Repairs
Unless otherwise stated in writing, device repairs performed by 970 Tech Solutions carry a 30-day limited warranty on parts and labor directly related to the specific repair performed. See our Warranty Policy for full details. This warranty does not cover: damage caused by liquid, drops, or physical impact occurring after the repair; issues unrelated to the original repair; unauthorized attempts by the customer or a third party to open or further repair the device; or normal wear and tear. Software services, IT support, and consulting work are provided on a best-effort professional basis and do not carry an implied warranty of specific outcomes beyond what is explicitly agreed in writing.
7. Web Development Warranty & Support
Newly launched websites include a 30-day bug-fix window covering functionality issues present at launch that were not caused by client-side edits, third-party plugin updates, or hosting changes made outside of our management. Ongoing maintenance beyond this window is available under a separate maintenance agreement.
8. Limitation of Liability
To the maximum extent permitted by law, 970 Tech Solutions' total liability for any claim arising out of or related to our services shall not exceed the amount actually paid by you for the specific service giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages. We are not responsible for data loss that occurs during repair, diagnostic, or IT service processes; customers are strongly encouraged to maintain independent backups of all important data before engaging our services.
9. Pre-Existing Conditions & Further Damage
Many devices submitted for repair already have pre-existing damage or degraded components not initially visible. We are not liable for pre-existing issues discovered during diagnosis or repair, nor for reasonable incidental damage that may occur while repairing an already-compromised device (for example, a fragile connector breaking during disassembly of a previously flooded device). We will make reasonable efforts to notify you if such an issue arises during the repair process.
10. Intellectual Property (Web Development & Custom Work)
For web development projects, ownership of final deliverables (site design, code, and content created specifically for the client) transfers to the client upon receipt of final payment in full. Prior to final payment, all work product remains the property of 970 Tech Solutions. We retain the right to showcase completed web development and design work in our portfolio, case studies, and marketing materials unless the client requests otherwise in writing and we agree to that request. Third-party assets (stock photography, licensed plugins, fonts, etc.) remain subject to their original licensing terms.
11. Acceptable Use of Our Website
You agree not to use 970techsolutions.com to submit false or fraudulent information, attempt to gain unauthorized access to our systems, upload malicious code, or interfere with the normal operation of the site. We reserve the right to refuse service to anyone who violates these terms.
12. Third-Party Services Disclaimer
Our website and business operations rely on certain third-party services, including but not limited to Cloudflare (security and hosting), Invoice Ninja (billing and client portal), and Cal.com (appointment scheduling). We are not responsible for outages, data handling practices, or errors originating from these third-party platforms, though we select and configure them with reasonable care.
13. Cancellations
Repair requests may be canceled prior to work beginning; any non-refundable diagnostic fee already charged (see our Mail-In Repair Terms) will not be refunded. Business IT, web development, and consulting engagements may be canceled per the terms of the specific proposal or agreement; deposits already paid for work performed are generally non-refundable.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Colorado.
16. Communications & Automated Tools
By providing a phone number or email address, you consent to receive service-related communications from us about your repair or project — by phone call, text message (SMS), and email. Full details, including how to opt out of SMS (reply STOP) or ticket-related emails, and our disclosure on the use of automated tools including artificial intelligence, are in our Privacy Policy.
